Hospital price transparency

Federal enforcement and state requirements

Last reviewed October 26, 2026

A CMS price transparency review answers the federal requirements in 45 CFR Part 180. It should not be used as a blanket conclusion that every state obligation has also been satisfied. The hospital's location and the particular state law matter.

Colorado illustrates why a separate check is needed. Its Department of Health Care Policy and Financing says SB23-252 builds on the federal rule by requiring Medicare rates in hospital price postings, requiring HCPF performance assessments, and making violations of hospital price transparency requirements a deceptive trade practice. These are Colorado-specific statements, not a national rule.

The HCPF page lists state implementation milestones and assessment reports, including a July 2026 report. A federal disclosure checklist does not by itself establish that the Colorado Medicare-rate posting requirement has been met. Conversely, a state assessment should be read for its own scope rather than presented as a substitute for CMS's determination.

Recommended practice is to maintain separate federal and state obligation records with the authority, applicability, effective date, required disclosure, enforcement body and review owner. Ask counsel to resolve applicability and remedies for the state at issue. This guide is an example of the overlay, not a 50-state survey or an opinion about debt collection rights.
