Hospital price transparency
The public enforcement record
The public enforcement record has more than one surface. CMS publishes civil monetary penalty notices on its enforcement-actions page, while the enforcement activities and outcomes dataset includes a broader set of review actions and outcomes. The two are not interchangeable lists of currently noncompliant hospitals.
The dataset describes hospital or location identity, CMS action or outcome, and the action date. CMS explicitly says the information is relevant as of the date noted and should not suggest an ongoing state of compliance or noncompliance. Its published update cadence is monthly; the release period matters when interpreting a row.
Penalty notices have their own status rules. Under 45 CFR 180.90, CMS marks a penalty under review when a hearing is requested, can publish a modified notice after a partial decision, and removes a notice if the penalty is overturned in full by a final binding decision. An older downloaded notice may not capture a later change.
Recommended practice is to retain the source URL, retrieval date, action date, release period and any review or modification status with an internal note. Do not turn an old action into a current compliance verdict or treat the number of published notices as a national noncompliance rate. This guide does not reproduce named hospital cases.
